These terms apply when your business sells through Loyalty Club: taking card payments with orders from your table menu, and taking online orders for collection or delivery from your shop link. They add to our Terms of Service. You accept them in the partner portal before you switch any of that on, and we record the version you accepted.
1. You are the seller
When a customer orders from you through Loyalty Club, the sale is between you and your customer. Your customers buy under our Terms of Sale, which say so. You are responsible for:
- what you sell, and your prices, descriptions and photos being accurate;
- VAT and any other tax on your sales;
- food safety and hygiene, including your registration with your local authority, and accurate allergen information — the allergens you tag on each item and your allergen notice;
- any licence what you sell needs, and checking the age of anyone buying age-restricted items;
- any other law that applies to your business and what you sell.
2. Taking orders
- Accept or decline each order promptly, and fulfil the orders you accept at the time the customer chose.
- If you cannot fulfil an order, decline or cancel it on your order board, which refunds a card payment in full and tells the customer.
- Keep what you offer up to date — items sold out, stock counts, collection and delivery times — and pause ordering when you cannot take orders.
3. Delivery
You deliver your orders yourself, or arrange delivery. Loyalty Club does not collect or deliver anything. An order is your responsibility until it reaches your customer.
4. Payments
Your customers pay into your own payment account with Square or Revolut. We never hold your money. Your payment provider's own terms and fees apply to those payments, and you are responsible for keeping your account with them in good standing.
5. Our fee
- We charge a fee on each order paid by card through Loyalty Club: a percentage of the order total, not counting any tip. The rate is shown in your partner portal under Settings → Payments; it is currently 2%.
- With Square, the fee is taken from each payment as it is made. With Revolut, it is added up each month and charged to the card on your Loyalty Club subscription, with a statement.
- Our fee is not refunded when you refund an order.
- We will give you at least 30 days' notice of any change to the rate.
6. Refunds, complaints and chargebacks
- You look after your customers' orders: questions, changes, complaints and refunds.
- If a customer cannot reach you and contacts us, we will pass their message to you, and you agree to respond promptly.
- Chargebacks and payment disputes are between you, your customer and your payment provider, as for any card payment you take.
7. Offers
Rewards at checkout, discount codes and bundle deals are offers you make to your customers. You set them up, you fund them, and you honour them as they were shown when the order was placed.
8. Customer information
You receive your customers' details — name, contact details and, for a delivery, the address, recipient and card message — to fulfil their order. Use them for that order only, and handle them in line with data protection law. Marketing to your customers goes through Loyalty Club, which respects the choices each member has made.
9. Switching off
We may pause or switch off card payments or online ordering for your business if you break these terms, if we receive repeated complaints about your orders, or if your payment provider asks us to. We will tell you why.
10. Changes to these terms
We may update these terms. We will tell you before a material change takes effect, and you will be asked to accept the new version before you switch on card payments or online ordering again. Selling after a change takes effect means you accept it.
11. Liability
The platform is provided as it is. We are not liable for sales or profits lost because it was unavailable. Our overall liability is limited as set out in our Terms of Service. Nothing limits liability for death or personal injury caused by negligence, or for fraud.
12. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
